Terms of Service
Last updated: September 19, 2026
These Terms of Service (“Terms”) govern your use of Surge (“Surge,” “we,” “us,” or “our”). By using Surge, you agree to these Terms. If you don’t agree, please don’t use Surge.
1. What Surge Does
Surge is a free tool that scans a storefront you submit and returns a scored report with suggested improvements. Surge is currently in early beta: features, availability, and accuracy may change, and we make no guarantee the service will be available at all times or free of errors.
2. Eligibility & Authorized Use
You must be at least 18 years old to use Surge. You may only submit a store URL for audit if you own that store or have the authorization of its owner to have it scanned. You’re responsible for making sure your use of Surge complies with any agreement you have with the store owner or platform (e.g., Shopify’s terms).
3. Accounts
You don’t need an account to run a free audit. If you create an account to save your audits, you’re responsible for keeping your login credentials secure and for all activity under your account.
4. Acceptable Use
You agree not to:
- Submit a store you don’t own or aren’t authorized to audit
- Use Surge to scan, scrape, or harass a site with abusive intent
- Attempt to disrupt, overload, or reverse-engineer Surge or its underlying infrastructure
- Use Surge for any unlawful purpose
5. Reports Are Suggestions, Not Guarantees
Surge’s scores and findings are generated automatically, including with the help of AI, from publicly available data about the store being audited. They are meant as helpful starting points, not professional, legal, technical, or financial advice, and we don’t guarantee they are complete, accurate, or that acting on them will improve any particular outcome. You’re responsible for evaluating any suggested changes before making them.
6. Intellectual Property
You retain ownership of your own store and its content. Surge and its underlying software, design, and technology are owned by us and are not being licensed or sold to you through your use of the service. Your audit reports are yours to use, keep, or share.
7. Third-Party Services
Surge relies on third-party services (including Supabase, Anthropic, Google, and Vercel) to operate. We aren’t responsible for outages, errors, or issues that originate with those providers.
8. Disclaimer & Limitation of Liability
Surge is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Surge and its operator won’t be liable for any indirect, incidental, or consequential damages arising from your use of the service, or for decisions made based on an audit report.
9. Termination
We may suspend or terminate access to Surge, for any user, at any time, particularly for violating these Terms. You may stop using Surge or delete your account at any time.
10. Changes to These Terms
We may update these Terms as Surge evolves. If we make material changes, we’ll update the “Last updated” date above. Continuing to use Surge after changes means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles.
